Terms of Service.

1. Scope

These Terms govern your use of the DigitalKnife mobile application ("the App"), operated by Catalin Cucu ("we", "us", "the operator"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. The Service

DigitalKnife is a digital toolkit for chefs, cooks, and food professionals, providing calculation, conversion, reference, and planning tools. Some features require an internet connection (including AI-assisted recipe search, music streaming, and online ingredient lookups); most other tools work offline. Features and tools may change, be added, or be removed over time.

3. Account & Sign-In

The App offers Sign in with Apple, Sign in with Google and email sign-in. You are responsible for maintaining the security of your Apple ID, Google Account or password, and for activity under your account. You can use the free tools without a subscription; certain features require a paid subscription.

4. Subscriptions & Billing

• Paid tiers (Chef and Kitchen Chef) are offered as auto-renewing subscriptions, billed monthly or annually through your Apple App Store account (iPhone, iPad) or your Google Play account (Android, see 5a).
• Payment is charged to your Apple ID or Google Play payment method at confirmation of purchase.
• On the App Store, subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the current period. On Google Play, you can cancel any time before the renewal date and keep access until the period ends.
• You can manage or cancel your subscription in your Apple ID account settings (iPhone, iPad) or in Google Play (see 5a). Deleting the App does not cancel a subscription.
• Every new account gets a 14-day free trial of all features, starting when the account is created. No payment details are needed. When the trial ends, your account stays on the free plan — the free tools remain available for as long as you keep your account — unless you choose a subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Prices are shown in the App and may vary by region. Prices may change; changes will be communicated in advance where required by law.

5. Right of Withdrawal (EU Consumers)

Purchases are subject to the terms and refund policy of the store you bought through (Apple App Store or Google Play). As digital content supplied immediately, the statutory 14-day right of withdrawal may not apply once the service has begun with your consent. Refund requests are handled by that store.

5a. Android, Google Play & Sign in with Google

• If you use the App on Android, paid subscriptions are purchased and billed through your Google Play account, and payment is charged to your Google Play payment method at confirmation of purchase.
• Purchases through Google Play are subject to Google Play's terms and refund policy. Refund requests are handled through Google Play: https://support.google.com/googleplay/answer/2479637.
• You can manage or cancel your subscription in the Google Play Store app under Profile → Payments & subscriptions → Subscriptions. Deleting the App does not cancel a subscription.

6. License

We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for your own professional or personal kitchen use, in accordance with these Terms and, depending on where you got the App, the Apple Media Services Terms and Conditions or the Google Play Terms of Service. You may not copy, redistribute, reverse-engineer, or resell the App or its content.

7. User Content

You retain ownership of content you create in the App (recipes, notes, meals, lists, etc.). You are responsible for that content. We do not claim ownership of it. When you are signed in, your content is stored with your DigitalKnife account (Google Firebase, Frankfurt) and synced across your devices and the Web Workspace.

8. AI-Generated Content

Some features generate content using artificial intelligence (for example, recipe suggestions). AI-generated content is provided as a culinary reference only. It may be inaccurate or incomplete and must not be relied upon for food-safety, allergen, dietary, or medical decisions. Always verify critical information independently.

9. Acceptable Use

You agree not to misuse the App, including attempting to disrupt the service, bypass tier restrictions, access it through unauthorised means, or use it for any unlawful purpose.

10. Disclaimer & Liability

The App is provided "as is". To the extent permitted by law, we make no warranty that the App will be error-free or uninterrupted. The tools provide calculations and references intended to assist professionals; they do not replace professional judgment, food-safety practice, or applicable regulations. To the extent permitted by Austrian law, our liability is limited to intent and gross negligence; we are not liable for indirect or consequential damages. Statutory consumer rights remain unaffected.

11. Availability

We aim to keep the App available but do not guarantee uninterrupted access. Online features depend on third-party services (e.g. Apple, Google, AI and data providers) and may be temporarily unavailable.

12. Changes to These Terms

We may update these Terms. Material changes will be communicated in the App. Continued use after changes take effect constitutes acceptance.

13. Termination

You may stop using the App at any time. We may suspend or terminate access for breach of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected. The place of jurisdiction is Salzburg, Austria, to the extent legally permissible.

15. EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. We are not obliged and generally not willing to participate in dispute-resolution proceedings before a consumer arbitration board.
